GENERAL TERMS AND CONDITIONS OF SALE
Definitions
These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) are offered by SSP26 SARL, with a share capital of €7,622, a company registered with the Paris Trade and Companies Register (RCS) under number B 498 018 985, registered under number 498018985, whose registered office is located at 10 boulevard de Strasbourg, 75010 Paris (hereinafter referred to as “SSP26”).
The following terms shall hereinafter be defined as:
“Website”: the website www.ht26.com and all of its pages.
“Products” or “Services”: all products (goods) and services (services) that may be purchased or subscribed to on the Website.
“Seller”: SSP26, a legal or natural person offering its Products or Services on the Website.
“Customer”: the Internet user, whether an individual or a professional, purchasing Product(s) or Service(s) on the Website.
“Consumer”, in accordance with the definition provided in the preliminary article of the French Consumer Code: “any natural person who acts for purposes that do not fall within the scope of their commercial, industrial, craft or professional activity.”
The Internet user visiting the Website and interested in the Products and Services offered by the Seller is invited to read these GTC carefully, to print them and/or save them on a durable medium before placing an order on the Website.
The Customer acknowledges having read the GTC and accepts them in their entirety and without reservation.
Article 1 - Application of the GTC and Purpose of the Website
The Seller reserves the right to modify the GTC at any time by publishing a new version thereof on the Website. The GTC applicable to the Customer are those in force on the date of their order on the Website.
The legal information concerning the hosting provider and publisher of the Website, the collection and processing of personal data, and the terms of use of the Website are provided in the general terms of use, legal notices and data policy of this Website.
This Website offers the online sale of cosmetics.
The Website is freely and gratuitously accessible to all Customers. The purchase of a Product or Service requires the Customer’s acceptance of these GTC in their entirety, and the Customer thereby acknowledges having fully read and understood them. This acceptance may, for example, consist of the Customer ticking the box corresponding to the statement accepting these GTC, which may read, for example: “I acknowledge that I have read and accepted all of the Website’s general terms and conditions.” Ticking this box shall be deemed to have the same legal value as a handwritten signature by the Customer.
Acceptance of these GTC requires Customers to have the necessary legal capacity to do so. If the Customer is a minor or does not have such legal capacity, they declare that they have obtained authorization from a guardian, curator or legal representative.
The Customer acknowledges the evidentiary value of the Seller’s automatic recording systems and, unless they are able to provide evidence to the contrary, waives the right to challenge them in the event of a dispute.
The Publisher makes available to the Customer on its Website a privacy policy specifying all information relating to the use of the Customer’s personal data collected by the Publisher and the rights the Customer has with regard to such personal data. The data privacy policy forms part of these GTC. Acceptance of these GTC therefore implies acceptance of the data privacy policy.
Article 2 – Creation of a Customer Account
The creation of a “customer account” is an essential prerequisite for placing any order on the Website. To this end, the Customer will be asked to provide a certain amount of personal information, such as their first and last name, email address, postal address and telephone number, this list not being exhaustive. The Customer undertakes to provide accurate information. The Customer is responsible for keeping their personal data up to date and must notify the Seller without delay of any changes. The Customer is solely responsible for the truthfulness, accuracy and relevance of the information provided.
Customers registered on the Website may access their account by logging in using their credentials (the email address provided upon registration and password), or, where applicable, by using third-party social network login systems. The Customer is entirely responsible for protecting the password they have chosen. Customers are encouraged to use complex passwords. In the event that the password is forgotten, the Customer may generate a new one. This password guarantees the confidentiality of the information contained in the “My Account” section, and the Customer therefore undertakes not to disclose or communicate it to any third party. Failing this, the Seller cannot be held liable for unauthorized access to a Customer’s account.
The customer account allows the Customer to view all orders placed on the Website. Should the data contained in the customer account section be lost as a result of a technical failure or force majeure event, the Seller shall not be held liable, as such information has no evidentiary value and is provided for information purposes only. The pages relating to the customer account may be freely printed by the Customer who holds the relevant account, but shall in no way constitute proof and are intended solely to facilitate the effective management of the Customer’s orders or contributions.
Each Customer is free to close their account on the Website. To do so, they must send an email to the Seller stating that they wish to delete their account. Once deleted, their data cannot be recovered.
The Seller reserves the exclusive right to delete the account of any Customer who has breached these General Terms and Conditions of Sale (including, without limitation, where the Customer has knowingly provided inaccurate information when registering or setting up their personal account), as well as any account that has been inactive for at least one year. Such deletion shall not constitute any loss or damage for the Customer, who shall not be entitled to claim any compensation as a result thereof. This provision does not prevent the Seller from taking legal action against the Customer where the circumstances justify such action.
Article 3 – Ordering Procedures and Description of the Purchasing Process
The Products and Services offered are those listed in the catalogue published on the Website. These Products and Services are offered subject to availability. Each Product is accompanied by a description prepared by the Seller based on the descriptions provided by the supplier.
The photographs of the Products displayed in the catalogue provide a faithful representation of the Products and Services offered but do not constitute a contractual commitment, insofar as they cannot guarantee an exact match with the physical Products.
The term “Cart” shall refer to the intangible item containing all Products or Services selected by the Customer on the Website for the purpose of purchase by clicking on those items. To place an order, the Customer selects the Product(s) they wish to purchase by adding them to their “Cart”, the contents of which may be modified at any time.
Once the Customer considers that they have selected and added all the Products they wish to purchase to their Cart, they may proceed with their order by accessing their Cart and clicking on the relevant button. They will then be redirected to a summary page displaying the quantity and characteristics of the Products ordered, as well as their unit price.
If the Customer wishes to confirm their order, they must tick the box confirming their acceptance of these General Terms and Conditions of Sale and click on the confirmation button. The Customer will then be redirected to a page where they must complete the order form. In this form, they will be required to provide certain personal information necessary for the proper processing of the order.
All orders placed on the Website must be duly completed and must include all required information. The Customer may make changes, corrections or additions to, or cancel, their order up until the order is confirmed.
Once the Customer has completed the form, they will be invited to proceed with payment using the payment methods listed in the payment section of these General Terms and Conditions of Sale. Shortly thereafter, the Customer will receive an order confirmation email summarizing the contents of the order and its total price.
The Products sold shall remain the property of the Seller until full payment of their price has been received, in accordance with this retention of title clause.
Article 4 – Prices and Payment Terms
Unless otherwise stated, the prices displayed in the catalogue are expressed in Euros, inclusive of all applicable taxes (VAT), taking into account the VAT rate applicable on the date the order is placed and excluding any applicable contribution towards processing and shipping costs.
SSP26 reserves the right to modify its prices at any time and, where applicable, to reflect any changes to the prevailing VAT rate in the prices of the Products or Services offered on the Website. However, the price displayed in the catalogue on the date the order is placed shall be the only price applicable to the Customer.
The Customer may place an order on the Website and make payment by credit or debit card or PayPal. Card payments are processed through secure transactions provided by an online payment service provider.
The Website does not have access to any data relating to the Customer’s payment methods. Payment is made directly to the bank or payment service provider processing the Customer’s payment. In the event of payment by cheque or bank transfer, the delivery periods set out in the “Delivery” section of these General Terms and Conditions of Sale shall only begin to run from the date on which the Seller effectively receives payment, which the Seller may prove by any means. Product availability is indicated on the Website, in the description of each Product.
SSP26 shall archive order forms and invoices on a reliable and durable medium constituting a faithful copy. The computerized records shall be deemed by the parties to constitute proof of communications, orders, payments and transactions carried out between the parties.
Article 5 – Delivery
Delivery costs will be indicated to the Customer before any payment is made. The Website has no geographical delivery restrictions, and orders may be shipped worldwide.
In the event that a Product is delivered outside the territory of the European Union or to the French overseas territories and departments (DOM-TOM), the Customer declares that they are the importer of the Product and acknowledges that, in such circumstances, the Seller may be unable to provide accurate information regarding the total amount of customs duties, customs formalities or import taxes applicable in the country where delivery of the Product is requested.
Unless otherwise stated on the Website during the ordering process or in the description of the Products ordered, the Seller undertakes, in all cases, to deliver the Products within a maximum period of thirty (30) days following the conclusion of the contract with a Consumer Customer.
The Customer may refuse a parcel upon delivery if they notice any issue relating to the delivery (damage, missing Product compared with the delivery note, damaged parcel, broken Products, etc.). Any such issue must then be expressly indicated by the Customer on the delivery note in the form of handwritten reservations, accompanied by the Customer’s signature. In order to exercise their right to refuse delivery, the Customer must open the damaged or defective parcel(s) in the presence of the carrier and have the damaged goods taken back by the carrier. Failure to comply with these requirements will result in the Customer being unable to exercise their right to refuse delivery, and the Seller will not be required to accept the Customer’s request to exercise such right.
If the Customer’s parcel is returned to the Seller by the postal service or other postal providers, the Seller will contact the Customer upon receipt of the returned parcel to determine how the Customer wishes to proceed with their order. If the Customer has mistakenly refused the parcel, they may request that it be reshipped, provided that they first pay the postage costs for the new shipment. Postage costs must be paid even for orders for which shipping was free at the time the order was placed.
In the event of a delivery error or exchange (where the right of withdrawal applies, i.e. where the Customer is a Consumer and the contract entered into for the purchase of the Product or Service is subject to the right of withdrawal pursuant to Article L.221-18 et seq. of the French Consumer Code), any Product to be exchanged or refunded must be returned to the Seller in its entirety and in perfect condition. Any defect resulting from mishandling or improper use by the Customer shall not be attributable to the Seller.
Any delay in delivery beyond the date or period indicated to the Consumer Customer at the time the order was placed, or, in the absence of any specified date or delivery period at the time of the order, beyond thirty (30) days from the conclusion of the contract, may result in the termination of the sale at the Consumer Customer’s initiative, upon their written request sent by registered letter with acknowledgment of receipt, if, after having formally requested the Seller to make the delivery, the Seller has failed to do so. The Consumer Customer will then be reimbursed, no later than fourteen (14) days following the date on which the contract was terminated, for all amounts paid. This clause shall not apply where the delivery delay is due to a force majeure event.
If a delivery cannot be completed by the carrier, the Customer will be fully refunded within fourteen (14) days, including delivery costs, but shall under no circumstances be entitled to claim any penalties, compensation or damages.
Article 6 – Right of Withdrawal and Withdrawal Form
In accordance with Article L.221-18 of the French Consumer Code, and where the right of withdrawal applies, the Consumer Customer has a period of fourteen (14) calendar days from the date of receipt of the Product ordered or, in the case of service contracts, from the date of conclusion of the contract, to exercise their right of withdrawal.
The Consumer Customer must return any Product that does not meet their expectations and may request an exchange or refund without penalty, with the exception of return shipping costs, within fourteen days from the date SSP26 receives the withdrawal request.
The Product must be returned in perfect condition. Where applicable, it must be accompanied by all of its accessories. The Consumer Customer may find below a standard withdrawal form for an order placed on the Website, to be sent to SSP26. The Customer shall be responsible for the cost of returning the Product in the event of withdrawal, as well as the cost of returning the Product where, due to its nature, it cannot normally be returned by post.
If the above requirements are not met, the Customer will forfeit their right of withdrawal and the Product will be returned to them at their expense.
Customers are advised to return the Product using a shipping method that provides parcel tracking. Otherwise, if the returned parcel does not reach the Seller, it will not be possible to initiate an investigation with the postal services in order to locate the parcel.
The refund will be made using the same payment method as the one used by the Customer for the initial transaction, unless the Customer has expressly agreed to the Seller using another payment method, and provided that the refund does not result in any fees for the Customer.
The Seller also reserves the right to defer the refund until the Product has been received or until the Customer has provided proof that the Product has been shipped, whichever occurs first.
In the event of any depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product(s), the Customer may be held liable.
In accordance with Article L.221-5 of the French Consumer Code (the “Hamon Law” of June 2014), the Consumer Customer may find below a standard withdrawal form for an order placed on the Website:

Article 7 – Product Warranties
Statutory provisions to be reproduced
When acting under the statutory warranty of conformity, the consumer has a period of two years from the date of delivery of the goods to take action. The consumer may choose between having the goods repaired or replaced, subject to the cost conditions provided for under Article L.217-9 of the French Consumer Code. Except in the case of second-hand goods, the consumer is exempt from having to prove the existence of the lack of conformity of the goods during the six months following delivery, this period being extended to twenty-four (24) months as of March 18, 2016.
The statutory warranty of conformity applies independently of any commercial warranty that may have been granted.
The consumer may also decide to invoke the warranty against hidden defects affecting the goods sold, within the meaning of Article 1641 of the French Civil Code, unless the seller has stipulated that they will not be bound by any warranty. Where this warranty is invoked, the purchaser may choose between rescinding the sale or obtaining a reduction in the purchase price, in accordance with Article 1644 of the French Civil Code. The purchaser has a period of two years from the date on which the defect is discovered to bring a claim.
The postponement, suspension or interruption of the limitation period may not have the effect of extending the limitation period beyond twenty years from the date on which the right arose, in accordance with Article 2232 of the French Civil Code.
All Products purchased on this Website are covered by the following statutory warranties, as provided for by the French Civil Code:
Statutory Warranty of Conformity
Pursuant to Articles L.217-4 et seq. of the French Consumer Code, the Seller is required to deliver goods that conform to the contract entered into with the Consumer Customer and is liable for any lack of conformity existing at the time of delivery of the Product. The statutory warranty of conformity may be invoked where a defect existed on the date the Customer took possession of the Product. However, when the defect appears within 24 months following that date (or within 6 months if the order was placed before March 18, 2016, or if the Product is sold as a second-hand item), it is presumed to have existed at the time of delivery. However, pursuant to Article L.217-7 of the French Consumer Code, “the Seller may rebut this presumption if it is incompatible with the nature of the [Product] or the alleged lack of conformity.”
After the expiry of this 24-month period (or 6-month period if the order was placed before March 18, 2016, or if the Product is sold as a second-hand item), the Customer shall be required to prove that the defect existed at the time they took possession of the Product.
Pursuant to Article L.217-9 of the French Consumer Code: “In the event of a lack of conformity, the purchaser may choose between having the goods repaired or replaced. However, the seller may refuse to proceed according to the purchaser’s choice if doing so would result in a cost that is manifestly disproportionate compared with the alternative, taking into account the value of the goods or the significance of the defect. The seller shall then be required to proceed, unless this is impossible, according to the option not chosen by the purchaser.”
Statutory Warranty Against Hidden Defects
Pursuant to Articles 1641 to 1649 of the French Civil Code, the Customer may invoke the statutory warranty against hidden defects where the defects affecting the Product were not apparent at the time of purchase, existed prior to the purchase (and therefore did not result, for example, from normal wear and tear of the Product), and are sufficiently serious. The defect must either render the Product unfit for its intended use or substantially impair its intended use to such an extent that the purchaser would not have bought the Product, or would have paid a lower price for it, had they been aware of the defect.
Complaints and requests for the exchange or refund of a non-conforming Product must be submitted by post or email to the addresses indicated in the legal notices of the Website.
In the event of non-conformity of a delivered Product, the Product may be returned to the Seller, who will arrange for its replacement. If the Product cannot be replaced (for example, because it is obsolete or out of stock), the Customer will be refunded the amount of their order by cheque or bank transfer. The costs associated with the exchange or refund procedure, including the return shipping costs for the Product, shall then be borne by the Seller.
Article 8 – Customer Service
The customer service department of this Website can be contacted by email at the following address: serviceclient@ht26.com or by post at the address indicated in the legal notices.
SSP26 also provides its Customers with a hotline or telephone assistance service to answer their questions. Telephone assistance can be reached at 01 40 18 51 00 (non-premium-rate number).
Article 9 – Liability
The Seller, SSP26, shall not be held liable for any failure to perform the contract entered into with the Customer resulting from the occurrence of a force majeure event. With regard to the Products purchased, the Seller shall not be liable for any indirect damages arising from these terms, loss of business, loss of profit, damages or expenses that may occur.
The choice and purchase of a Product or Service are made under the sole responsibility of the Customer. The total or partial inability to use the Products, particularly due to hardware incompatibility, shall not give rise to any compensation, refund or liability on the part of the Seller, except in the event of a proven hidden defect, lack of conformity, defect, or exercise of the right of withdrawal where applicable, i.e. where the Customer is a Consumer and the contract entered into for the purchase of the Product or Service allows for withdrawal pursuant to Article L.221-18 et seq. of the French Consumer Code.
The Customer expressly acknowledges that they use the Website at their own risk and under their sole responsibility. The Website provides information to the Customer for informational purposes only and may contain imperfections, errors, omissions, inaccuracies and other ambiguities. In any event, SSP26 shall under no circumstances be held liable for:
- any direct or indirect damage, including loss of profits, loss of revenue, loss of customers or loss of data, which may result from the use of the Website or, conversely, from the inability to use the Website;
- any malfunction, unavailability of access, improper use, incorrect configuration of the Customer’s computer, or the use of a browser that is not commonly used by the Customer;
- the content of advertisements and other links or external sources accessible by Customers through the Website.
The photographs and visual representations of the Products displayed on the Website are not contractually binding. Consequently, the Seller shall not be held liable if the characteristics of the Products differ from the visual representations displayed on the Website, or if such representations are inaccurate or incomplete.
Article 10 – Intellectual Property Rights
All elements of this Website belong to the Seller or to an authorized third party, or are used by the Seller with the permission of their respective owners.
Any reproduction, representation or adaptation of logos, written, pictographic or video content, without this list being exhaustive, is strictly prohibited and may constitute an infringement of intellectual property rights.
Any Customer found to have committed an infringement may have their account deleted without prior notice or compensation, and such deletion shall not entitle the Customer to claim any damages. This shall be without prejudice to any subsequent legal proceedings that may be initiated against the Customer by the Seller or its authorized representative.
The trademarks and logos contained on the Website may be registered trademarks of SSP26 or, where applicable, of one of its partners. Any person who reproduces, represents, incorporates, distributes or redistributes them may be subject to the penalties provided for under Articles L.713-2 et seq. of the French Intellectual Property Code.
Article 11 – Severability of Provisions
If any provision of these General Terms and Conditions of Sale is deemed illegal, invalid or otherwise unenforceable, that provision shall be considered severable from these General Terms and Conditions of Sale and shall not affect the validity or enforceability of the remaining provisions.
These General Terms and Conditions of Sale supersede all prior or contemporaneous written or oral agreements. The General Terms and Conditions of Sale may not be assigned, transferred or sublicensed by the Customer.
A printed version of these General Terms and Conditions of Sale and of any notices provided electronically may be requested in connection with judicial or administrative proceedings relating to these General Terms and Conditions of Sale. The parties agree that all correspondence relating to these General Terms and Conditions of Sale shall be conducted in French.
Article 12 – Applicable Law and Mediation
These General Terms and Conditions of Sale are governed by and subject to French law.
Unless otherwise provided by mandatory legal provisions, any disputes that may arise in connection with the performance of these General Terms and Conditions of Sale may, prior to any legal proceedings, be submitted to the Website Publisher for the purpose of seeking an amicable resolution.
It is expressly stated that requests for amicable settlement do not suspend the time limits available for bringing legal proceedings. Unless otherwise provided by mandatory legal provisions, any legal action relating to the performance of these General Terms and Conditions of Sale shall fall within the jurisdiction of the courts having territorial jurisdiction over the place of residence of the defendant.
Consumer Mediation
Pursuant to Article L.612-1 of the French Consumer Code, it is recalled that “every consumer has the right to seek, free of charge, the assistance of a consumer mediator for the amicable resolution of a dispute with a professional. To this end, the professional guarantees the consumer effective access to a consumer mediation mechanism.”
Accordingly, SSP26 offers its Consumer Customers, in the event of disputes that have not been resolved amicably, the assistance of a consumer mediator, whose contact details are as follows:
ACCREDITED CONSUMER MEDIATOR
CM2C
14 rue Saint Jean
75017 Paris
https://cm2c.net/
cm2c@cm2c.net
It is hereby recalled that mediation is not mandatory but is offered solely as a means of resolving disputes without having to resort to legal proceedings.
Article 13 – WhatsApp and Facebook Privacy Statement
By sending the initial message, I declare that I accept SSP26’s internal data protection rules, in accordance with Article 6(1)(a) of the GDPR. I expressly consent to the collection, storage, processing and use of the following personal data (first and last name, telephone number, Messenger ID, profile picture, as well as the content of messages / updates) in connection with the use of the messaging service, in order to enable messages to be sent. Use of the messaging service requires a valid and active account with the messaging service provider.

Article 15 – Delivery Charges – Orders Outside the European Union
For any order shipped outside the European Union, the delivery charges indicated at the time of ordering are estimates.
The final weight of the parcel, which is used as the basis for calculating shipping costs, can only be determined once the order has been fully prepared and the parcel has been finally packaged.
Consequently, in exceptional cases, an adjustment to the delivery charges may be required once the parcel has been prepared and the shipping label issued, particularly when the actual weight of the parcel is higher than initially estimated.
The customer will be informed of the exact amount of any additional shipping charges to be paid before the order is shipped.
The customer expressly acknowledges and accepts this principle of adjustment of delivery charges, which remains rare and is based on the actual weight of the parcel determined after preparation.
Any customs duties, import taxes, local duties and taxes, as well as any other fees or charges that may be imposed by customs authorities or the carrier upon arrival of the parcel in the destination country, shall be borne entirely by the customer. These charges are separate from the delivery charges paid when placing the order and cannot be claimed from the seller. The customer is advised to check with the relevant authorities in their country regarding any applicable import duties and taxes before placing an order.
In the event that the customer refuses to pay the additional shipping charges, the order may be cancelled and refunded, excluding any costs already incurred.
